GreenPen Terms of Service

GreenPen is operated by Wright Education Group Ltd, Companies House No. 17128367, 128 City Road, London, EC1V 2NX. In these terms, “we”, “us” and “our” mean Wright Education Group Ltd.

These Terms of Service apply to access to and use of GreenPen unless your school or organisation has entered into a separate written agreement with us.

Where your organisation has entered into a separate written agreement with Wright Education Group Ltd for GreenPen, that agreement governs your organisation’s use of GreenPen and prevails over these Terms to the extent of any conflict.

By using GreenPen, you agree to use it only for lawful, authorised school or organisational purposes and in line with these terms and any policy set by your organisation.

You may use GreenPen only if you are authorised by your school or organisation.

You must keep your account details secure and must not share your login with anyone else.

You must tell your organisation or us promptly if you believe your account has been compromised.

You must not use GreenPen unlawfully, abusively, fraudulently or in a way that could harm the service, other users or any person.

You must not attempt to gain unauthorised access to GreenPen, its infrastructure, data, source code or connected systems.

You must not introduce viruses, malware or harmful material, scrape or overload the service, or bypass security controls.

You must enter only information that you are authorised to process and that is appropriate for GreenPen’s educational purpose.

Your school or organisation is responsible for deciding what personal data is entered into GreenPen and for providing any privacy notices required by law.

GreenPen should not be used as a general safeguarding case management system, medical record system or repository for highly sensitive information unless your organisation has agreed that use with us in writing.

We process school data to provide, secure and support GreenPen, subject to any separate agreement with your organisation.

GreenPen, including its software, design, structure, documentation and related materials, belongs to Wright Education Group Ltd or its licensors.

You may use GreenPen only as permitted by these terms or your organisation’s agreement with us.

Your organisation retains its rights in the school data it enters into GreenPen.

We aim to keep GreenPen available and useful, but we do not guarantee that it will always be uninterrupted, error free or available at all times.

We may update, change or improve GreenPen from time to time.

Support routes and response times may be set out in a separate agreement with your organisation.

We may suspend access where reasonably necessary for security, maintenance, legal compliance, non-payment, misuse or breach of these terms.

Your organisation may control or remove your user access at any time.

When an organisation’s agreement with us ends, access to GreenPen and data export or deletion will be handled under that agreement where applicable.

Nothing in these terms limits liability that cannot lawfully be limited, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.

GreenPen supports educational and administrative workflows, but your organisation remains responsible for professional judgement, assessment decisions and safeguarding decisions.

Where a separate written agreement applies, liability is governed by that agreement.

These terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, except where a separate written agreement says otherwise or mandatory law requires otherwise.

We may update these terms from time to time. The latest version should be made available through GreenPen or our website. If a separate written agreement applies, changes to these public terms do not override that agreement.
